Well, no response from KymcoUSA, no response from the dealer, no new front cover...  Today I sent a certified mail letter to officially put KymcoUSA on notice as to their obligation under the warranty.  By NY law, they have 20 days from receipt of the letter to repair the scoot or I can apply to the attorney general's office for an arbitration.  If they continue to refuse to repair, and I consider their ignoring this matter to be the equivalent of a refusal, then I can request a full refund.  Not something I want to do, considering I love my Super 8 and took a long time to choose just the right scooter for me, but they are pushing towards that being the only resolution. Though I have it taped on, I really have to wonder if the scoot would pass inspection as it is now, as it frankly is a safety issue.  With every stop I am at, I have to glance down to make sure it's still there, and if possible reach around to make sure it's holding on firmly.  Not really something I should have to do during my rides, not to mention how crappy it looks.  I knew my dealer would be a about this once they told me they were no longer handling Kymcos, but KymcoUSAs response (or complete lack thereof) is VERY disappointing! >:(

We've all seen this before. Email EVERYDAY! Call EVERYDAY! Don't skip one business day. Let them know their/your efforts are recorded here on Kymco Forum. I am sure they are aware of us.

Link the thread in your Emails. They will make this right for you. Don't worry.
They don't want to lose you, and We don't want to lose you.

Thanks for the pep talk, Zombie.  I decided to forward them a copy of my letter to hopefully light a fire under them.  Btw, sorry about using a curse in my last post; I am so not happy about the many crappy facets of this mess.

Kymco's reply to my e-mail and my response...

Denise,

I received your letter today and wanted to contact you since you have apparently not had returned contact with others in our organization or your dealer.

This matter has been addressed with your dealer and should be handled by your dealer. These parts were not factory installed but installed by the dealer upon setup of the vehicle. With that in mind the dealer should be responsible for any loss or damage to these parts due to improper installation. It has been my understanding that our district manager has discussed this with your dealer and that it is/ was being handled as it should. I will be sure that the dealer is contacted once again to see what they may be doing to resolve this for you. If you have any further concerns please let me know. I also left a message on your answering machine but was cut off before completing it.

I’ve reviewed your response, and frankly do not understand it.  I have been the only one who has initiated any contact over this matter, and have done so several times in various forms.  I finally received this response after three e-mails to KymcoUSA (dated 7-14, 7-17 and 7-21).  My last e-mail to my dealer was dated 7-11, after I received a message on my answering machine from Steven that Yamaha/Suzuki of Mineola had not ordered the parts required to fix my scooter (this was three weeks after I gave them notice in person of this incident).  I received no response to that e-mail whatsoever.

As I mentioned in my e-mail to KymcoUSA dated 7-14, the personnel at Yamaha/Suzuki of Mineola advised me when I went to the dealership on 6-21-14 to report the incorrectly installed and damaged front cover that they are no longer handling sales or service of Kymco products.  Where does that leave me?  I’m already very annoyed over the fact that Yamaha/Suzuki of Mineola sold me the scooter without first advising me that they would discontinue servicing Kymcos less than two months later and leaving me without a Kymco service location within close proximity to me.

I would appreciate if you would provide me with the name and phone number of the Kymco district manager so I may speak to him directly about this.  I would also like a copy of the set up instructions for my scooter; since I was given the scooter after the dealer prep was done I have no way of knowing which are installed by the manufacturer and which by the dealer.

I am copying Yamaha/Suzuki of Mineola in on this e-mail, and will also send a copy of the correspondence I sent to KymcoUSA yesterday via a separate e-mail so they can see it as well.  The bottom line is that my scooter must be repaired and at no cost to me, and that this needs to be done very soon.  I suggest all the required parts with installation instructions be sent directly to me immediately, I can bring them and the scooter to Yamaha/Suzuki of Mineola for the installation, and the differences between manufacturer and dealer can be resolved between you.  Whether this part fell from the scooter due to manufacturer error or dealer error is immaterial to me; this damage is in no way my fault and I have waited over a month now to have it resolved.  Kindly work together now to resolve this for me.  Thank you for your anticipated cooperation in this matter.

Second round of e-mails...

On Tue, Jul 22, 2014 at 11:46 AM, Steven Oliver <soliver@kymcousa.com> wrote:

Denise,

We initiated contact with your dealer after I left you the previous message. It was then my understanding (though apparently incorrect) that your dealer would be contacting you.

We are not set up to sell or send anything to consumers directly. Therefore I cannot send you any parts or instruction directly. They must be sent to your dealer.

I also cannot give you contact information for our District manager but will let him know you would like to speak to him and he may then contact you.

Be assured that it is our interest to see that your unit gets repaired as it should be.

 Steven

I understand your point, Steven, but the fact is that, per conversation on 6-21-14 with Mike in the service dept. and Luis in sales of Yamaha/Suzuki of Mineola, I no longer have a Kymco dealer.  Do you see in your system that they even ordered the parts yet?  Can you place the parts order (from the pictures and schematic you should be able to ascertain all the parts that are needed) and express mail them with the installation instructions (which will be necessary because Mike advised that they sent all their Kymco stuff back) to Yamaha/Suzuki of Mineola so that I can take the scooter there to be repaired?

As you can see, I am in a quandary not of my own making with this situation.  I would appreciate that whatever is necessary be done to restore my scooter to its original condition.  I hope your district manager is looking for another dealership in Nassau County with whom to place the Kymco account.  Might I suggest Island Powersports in Massapequa.  I know nothing of their work but they are in a good location with a large facility that could probably fit a few Kymcos, and I see they got a lot of good reviews on google.

I would venture a guess there are no dealers out in Suffolk... That's most likely gonna leave you w/ the city for warranty.

Bottom line is you now have their attention. I think I would continue a daily email "status report

Good news and I hope I'm not jinxing it by mentioning it here.  ;D  Evidently my correspondence lit some fires, and I got an e-mail from the dealership that they have the parts.  I've got an appt. for Saturday morning to have it installed and my scoot restored to its proper, excellent condition.  Zombie, there is a dealership in Suffolk, about the same distance as the one in Queens would be from me.  The thing is that places are distances I never planned to travel with the scooter.  I bought it for back streets just tooling around riding.  Even to go to the dealership in Mineola I found a backroads way to get there to avoid Jericho Tpke.   I don't feel comfortable going more than 40MPH on the S8; 30-35 is better for me, and if you go on any of the main highways at these speeds around here you'll get flattened.

Crossing my fingers for you. How about a "Victory Pic" of the front end after all is said and done. The speeds you are used to going comfortably will increase over time. When I first got my scoot, I thought 40MPH was pretty fast. You get used to the speeds quickly and can increase it over time without feeling like you are out of control.

A friend of mine had his whole exhaust end can fall off his scooter while riding a couple of years ago (SYM Fighter 150)!!! After I heard that, went out to check that the bolts on my Super 8 125 were tight. I have been checking them bolts every now and then.

Yeah, I check on my bolts too--never a bad idea to keep a close eye on your scoot.  You can bet I'll be keeping a close eye on the new front cover, in fact I think I may keep a couple of pieces of tape on it for a little extra security, and I'm planning on putting some vibra tite on the bottom screw.  I'll be posting a pic of my newly restored scoot--looking forward to that!

Good news--the scoot is fixed!  It looks terrific.  I took photos on my ipod and have to figure out how to get them here.  Just so good to have this mess behind me.
